Statute

§ 1
Purpose of the competition


The aim of the Smart City Poland Award competition (hereinafter referred to as the "competition") is to search for, reward and promote innovative solutions implemented in local government units in Poland, which are characterized by above-average creativity in their approach to combining modern technologies with the needs of local communities of cities and regions. These innovations may include modern technology, service or procedure, they should also serve as an example of good practices that can be implemented and disseminated in other local government units.

 

§ 2
Organizer and Co-organizer

  1. SCEP SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ with its registered office in Warsaw, ul. Hoża 86/410 (00-682 Warsaw), registered in the Register of Entrepreneurs kept by the DISTRICT COURT FOR M. ST. WARSZAWA IN WARSZAWA, XII COMMERCIAL DEPARTMENT OF THE NATIONAL COURT REGISTER, under the KRS number, 0000768306, NIP number: 7010903434, (hereinafter referred to as the "Organiser").

  2. The Organizer may outsource some of the activities related to the organization of the competition to a selected Co-organizer.

 

§ 3
Competition jury

The jury of the competition is appointed and dismissed by the organizer of the competition. The Jury consists of experts, representatives of the world of science and business, whose many years of professional experience is related to the functioning of local government units in their various aspects and spheres of operation. The full list of Jury members is available on the Organiser's website.

§ 4
Contest participants

  1. Competition participants may be:
    1) Local government units (hereinafter: local government units) of all levels where the solution to which the application relates has been implemented.
    2) It is possible to submit one application jointly by several local government units if the application concerns the area of several local government units.
    3) Entrepreneurs who are producers or suppliers of technologies or services that have been implemented in local government units. In this case, the applicant must have a declaration of consent of the local government unit in whose territory the solution has been implemented for its application to the competition. If the implementation was carried out jointly in the area of more than one local government unit, the applicant must have a declaration of consent from all local government units concerned by the implementation.

  2. In the case of the competition category described in § 5 point 1, only local government units may participate in the competition.

  3. Solutions implemented in the territory of the Republic of Poland may be submitted in the competition.

  4. Applications for participation in the competition may not be submitted by members of the jury or their relatives, as well as commercial law entities where a member of the jury is employed. If, during the work of the jury, it turns out that there are justified doubts as to the impartiality of any of the members of the jury, the organizer has the right to dismiss them.

 

§ 5
Competition categories

  1. The Most Smart City Award: The most intelligent city of the year - the award is granted to a local government unit that implements a coherent smart city strategy and implemented innovative solutions in a given year in the widest range of areas of local government operation related to the smart city concept.

  2. Smart City Poland Award - Mobility: An award in the field of urban mobility awarded for the best investment or modernization in the field of transport and transport infrastructure.
     

Examples of projects submitted for the award:

  • Modernization of the existing infrastructure,

  • Introduction of new solutions in local government transport,

  • New investments in transport infrastructure,

  • Projects introducing low-emission local government transport,

  • e-mobility.

  3. Smart City Poland Award - e-services: Award for the best implementation of projects facilitating access to services for residents   

      public (e-government):
 

Examples of projects submitted for the award:

  • "e-office",

  • finance and payments,

  • internet of things,

  • services of municipal companies.

    4. Smart City Poland Award - environmental protection: Award for the most innovative approach to environmental protection and pro-ecological activities in local government units (green city):

 

Examples of projects submitted for the award:

  • local government solutions in the field of renewable energy sources,

  • anti-smog solutions,

  • waste management, closed circuit, municipal sewage treatment,

  • investments in public greenery,

  • appropriate planning of space, taking into account the needs of the natural environment,

  • "blue and green" infrastructure,

 

  5. Smart City Poland Award - innovative economy: Award for innovative projects and activities to support and promote

Examples of projects submitted for the award:

  • stimulating local entrepreneurship,

  • supporting start-ups,

  • will attract and service investors,

  • economic promotion of local government units.
     

  6. Smart City Poland Award - protection of public health and projects addressed to people with disabilities: Award for

      the most innovative approach to protecting public health in the city.

 

Examples of projects submitted for the award:

  • monitoring the health parameters of residents,

  • programs for financing health services of endangered social groups,

  • infrastructure solutions for the disabled.

 

  7th Smart City Poland Award - Urban infrastructure
 

Examples of projects submitted for the award:

  • Street furniture and street furniture,

  • "Smart Building",

  • urban lighting systems,

 

  8th Smart City Poland Award - public safety:

  • city monitoring,

  • crisis management systems,

 

§ 6
Application for participation in the competition

  1. Projects whose implementation has been completed by August 30, 2023 can be submitted to the competition. In the case of construction projects, the date of acceptance of the investment is considered to be the project completion date.

  2. The condition for making a correct notification is to perform the following actions:
    1) Sending the application by September 10, 2023, via the form available on the organizer's website
    2) Payment of a fee in the amount of PLN 2,000 net + 23% VAT for each entry to the competition,

  3. Providing incomplete or false data in the form is the basis for rejection of the application.

  4. The competition entry fee is non-refundable,

  5. Members of the competition jury may not disclose materials and information related to the competition to third parties,

  6. The jury, through the organizer, may contact applicants to clarify certain information or incomplete forms.

 

§ 7
Basic evaluation criteria

  1. All complete applications submitted by authorized entities in due time and meeting the formal requirements referred to in § 6 will be subject to evaluation.

  2. When evaluating applications, the Jury will be guided by the regulations of the Jury's work together with individualized criteria for individual competition categories.

    1) In the category referred to in § 5 point 1, the following will be taken into account: the following criteria:
    a) The number of implementations of the smart city idea in various areas of local government functioning,
    b) Strategic documents adopted by the legislative body of a given local government unit regarding the implementation of the Smart City idea,
    c) Certificates held in the area of smart city,
    d) Innovative compared to global solutions - nature of technology or services,

    2) In the category referred to in § 5 point 2, the following will be taken into account: the following criteria:
    a) Innovative compared to global solutions - the nature of the technology or service,
    b) Originality of the project,
    c) Cost-effectiveness of implementation and its operational advantages (price, operating and service costs),
    d) The impact of the project on the environment,
    e) The impact of the project on improving the lives of residents,
    f) Impact of the project on changing the behavior and habits of residents,

     

  3. In the category referred to in § 5 point 3, the following will be taken into account: the following criteria:
    a) The number of services that can be arranged online thanks to the implemented solution,
    b) Originality of the project and the use of modern technological solutions,
    c) The impact of the project on changing the behavior and habits of residents,
    d) Impact of the project on improving the quality of life of residents,
    e) Ease of application of a given solution, its implementation in other local government units,

     

  4. In the category referred to in § 5 point 4, the following will be taken into account: among others the following criteria:
    a) Innovative nature of the technology or service compared to global solutions,
    b) The impact of the solutions applied on the natural environment, including the amount of emissions discharged or the amount of municipal waste produced,
    c) Impact of the project on improving the quality of life of residents,
    d) The impact of the project on changing the behavior and habits of residents,

     

  5. In the category referred to in § 5 point 5, the following will be taken into account: the following criteria:
    a) Innovativeness of activities for the development of entrepreneurship (including start-ups),
    b) Efficiency and efficiency of activities aimed at attracting and servicing investors,
    c) Creativity of conducted economic promotion activities,
    d) Innovativeness of the local economy,
    e) Quantity and quality of BEI.

 

§ 8
The process of selecting winners

The selection of the winners of the competition takes place in two stages:

  1. Stage I - verification of applications in formal and legal terms. At this stage, the completeness of applications will be checked, as well as whether they are substantively related to the competition categories listed in § 4.

  2. The Jury, through the Organizer, has the right to request by e-mail the participant to supplement the information contained in the application. If the Participant does not respond within 7 days of sending the inquiry - the application will not be considered.

  3. Stage II – selection of the best applications in each category.

  4. The jury, as part of the internal regulations of the jury's work, will determine the detailed rules for awarding the minimum and maximum number of points for meeting the competition criteria, according to which individual applications will be assessed.

 

§ 9
Award and announcement of winners

  1. The prize in the competition is the "Smart City Poland Award" statuette with a promotional package including:
    1) materials in the electronic version: press release about the winners, book of the "Smart City Poland Award" trademark,
    2) publishing information about the winner on the websitewww.smartcityexpo.pl,
    3) publication of information about the winner in a national daily
    4) if the winner of the competition is also a fair exhibitor, he/she receives a large sticker identifying the stand at the fair,
    5) if the winner of the competition is also a trade fair exhibitor, information about winning the competition will be included in the trade fair catalogue,
    6) photo documentation of the above-mentioned event.

  2. The Jury of the Competition will announce the decision to award the prize referred to in sec. 1 by September 30, 2023 via the Organiser.

  3. Participants of the competition whose products have been awarded may publish information about the award and the graphic image of the award in advertising publications and other publications - only on the awarded products and their packaging.

 

§ 10.

Data processing

  1. The administrator of personal data processed for the purposes of the Competition is SCEP SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ with its registered office in Warsaw, ul. Hoża 86/410 (00-682 Warsaw), registered in the Register of Entrepreneurs kept by the DISTRICT COURT FOR M. ST. WARSZAWY IN WARSZAWA, XII COMMERCIAL DEPARTMENT OF THE NATIONAL COURT REGISTER, under the KRS number, 0000768306, NIP number: 7010903434. Personal data will be processed for the purpose of:
    1) conduct and implement the Competition, based on the consent referred to in art. 6 sec. 1 lit. a of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation personal data) hereinafter referred to as "GDPR";
    2) settlement of the Competition - in the case of receiving a prize, pursuant to art. 6 sec. 1 lit. c GDPR and;
    3) legitimate interest in answering any inquiries, pursuant to art. 6 sec. 1 lit. f GDPR.

  2. Personal data of the Competition participants or persons who submit the application on behalf of the Unit / Institution / Company will be provided to the members of the Competition Jury appointed by the Competition Organizer. Personal data of the Competition Winners and their representatives, and in the case of expressing a separate consent - also their image, may be transferred and then published on:
    1) websites of the Organizer, Co-organizer, Partners, Patrons and Sponsors of the Smart City Poland Award competition.
    2) profile of the Organizer, Co-organizers, Partners, Patrons and Sponsors on Facebook, Linkedin
    3) on the website of the Organizer and Co-organizer (www.smartcityexpo.pl)

  3. Personal data will not be transferred to a third country or an international organization.

  4. Personal data will be processed no longer than it is necessary for the proper conduct and implementation of the Competition, its settlement, answering any inquiries and for the period during which we store the data contained in the competition documentation for archival purposes. In the case of data published by the Organizer and Co-organizer and in the event of consent to the dissemination of the image, the data will be published for no longer than 2 years. After the expiry of the above-mentioned periods, personal data will be deleted.

  5. Participants of the Competition and persons representing them have the right to:
    1) to withdraw consent at any time without affecting the lawfulness of the processing which was made on the basis of consent before its withdrawal; withdrawal of consent means withdrawal of participation in the Competition and it is possible by sending an e-mail to the following address: biuro@smartcityexpo.pl or submitting a resignation by sending it to the address indicated in section 1, or submission in person at the Organizer's office;
    2) to demand from the Organizer access to the data of the person submitting the competition application and the institution that this person represents and the right to rectify, delete or limit processing, the right to object to their processing and the right to transfer data;
    3) to lodge a complaint with the Office for Personal Data Protection, when they consider that the processing of personal data concerning them violates the provisions on the protection of personal data.

  6. Providing personal data of the person submitting the competition application on behalf of  of the Competition Participant is a prerequisite to participate in the Competition, the consequence of not providing personal data will be the inability to participate in the Competition.

  7. The scope of personal data processed in the Competition includes data of persons submitting an application on behalf of the Competition Participant, which is a category of ordinary data, in the scope of: name and surname, e-mail address, telephone number, position.

  8. The data provided will not be used for profiling or making automated decisions.

  9. The Organizer does not intend to process data for purposes other than those described in § 8 and § 9 of these regulations.

 

§ 11
Final provisions

  1. The Participant taking part in the Competition accepts the terms of the Regulations.

  2. The decision of the Competition Jury cannot be appealed against.

  3. Any doubts arising during the validity of these Regulations shall be resolved by the Organizer.

  4. The Organizer reserves the right to change the Regulations for important reasons, as long as it does not affect the deterioration of the conditions of participation in the Competition or the rights of Participants, including extending its duration.

  5. The Participant of the Competition declares that if he receives the Prize, he consents to the publication of his name and surname or company name in promotional materials related to the Competition, in particular on the Organizers' websites, and also agrees to their use for promotional and marketing purposes.

  6. In matters not covered by the Regulations, the provisions of the Civil Code shall apply.
